The agreement between Atolys and customers using imagery, connectivity or network services.

These terms govern use of the Atolys platform, imagery products, connectivity services and build projects. A signed order form or statement of work prevails where it differs.
Imagery is licensed, not sold. The tier chosen at order determines permitted use, and is recorded against the scene. Derived analytics you compute are yours under every tier; the underlying pixels remain under licence. Redistribution outside your tier requires a written upgrade.
We schedule captures against the constellation plan and publish feasibility before you order. Captures that fail your stated cloud or angle limits are not billed and are re-tasked automatically. We cannot guarantee weather, and no tier of priority changes that.
Service levels are those stated in your order. Availability targets exclude published outages of the underlying satellite operator, scheduled maintenance notified in advance, and failures caused by customer power or site changes. Terminals remain our property on managed plans.
Surveys are chargeable and credited against a proceeding build. Builds are fixed price against an agreed design; changes to scope are quoted before work proceeds. Acceptance is against the measured criteria in the design document.
You may not use imagery to identify or track individuals, resell raw scenes outside your licence tier, or use our services in breach of export control or sanctions. We may suspend an account that does, and we will say why.
Imagery is billed on delivery, connectivity monthly in arrears, builds at agreed milestones, all in euro. Late payment may lead to suspension after notice.
To the extent permitted by law, neither party is liable for indirect or consequential loss, and our aggregate liability is limited to fees paid in the preceding twelve months. Nothing limits liability that cannot be limited by law. Decisions taken on the basis of imagery remain yours.
Slovak law, with the courts of Bratislava having jurisdiction, unless mandatory local law provides otherwise.
